SECURE RESERVATION PROCESSING
This online service utilizes a reservation system called Occupancy Plus. Although the reservation service is provided by Occupancy Plus your reservation is being

entered directly into the hotels reservation system and at the Hotels own rates.

Requests for early check-in between 9AM to 1PM is subject to room availability. A half day charge shall be imposed on the confirmed date.
Early check-in will be charged PHP 200 per hour.

Requests for late check-out between 1PM to 5PM is subject to room availability. A half day charge shall be imposed on the confirmed date.

Cancellation If you wish to cancel your reservation the booking fee is non refundable. The booking fee, first night or price of the accommodation may still be charged depending on the policy of the hotel that you agreed to at the time of making the reservation.

OccupancyPlus.com and v12-secure.com are domain names operated by Subicom Inc., Times Square Complex, Rizal Avenue, Subic Bay Freeport Zone, Philippines hereafter “Subicom”.

SUBICOM acts as booking agent for the hotels and other service providers advertised on the websites operated by SUBICOM and or websites operated by hotels or aggregators (the "Sites").

By using and/or visiting the Sites you agree to these General Terms and Conditions, the Privacy Policy and the Terms of Use ("the Terms") and you expressly consent and agree to be bound by the Terms and all applicable laws and regulations that govern this Sites and your booking.

References to "accommodation providers" means the owner/providers of the hotels, apartments, villas and other accommodation of any description featured on these websites and "accommodation" means the accommodation including all facilities and services advertised on the Sites that SUBICOM has agreed to arrange in connection with your confirmed booking.

Affiliates are third parties who, in agreement with SUBICOM, distribute SUBICOM hotel rooms to their customers.

IMPORTANT INFORMATION
SUBICOM acts as a booking agent only in respect of all bookings SUBICOM makes on your behalf. SUBICOM undertakes no responsibility for, and are not liable for, the misrepresentations, breaches of contract, breaches of statutory duty or negligence of any of the accommodation providers and other suppliers of services who sell their products and services through us. This means that in the event of you suffering personal injury, illness or death as a result of any act or omission of an accommodation provider or other supplier of services (or their employees or agents) or you having any complaint about the quality of the services provided or having any other complaint at all, your sole right of redress will be against the independent third party who provided such service and SUBICOM will be under no liability at all (whether in contract, tort or otherwise howsoever).

You accept that SUBICOM has not in any way selected or assembled your travel arrangements for you. Your accommodation arrangements are not a package and do not fall within the meaning of The package Travel, Package Holidays and Package Tours Regulations 1992.

By proceeding to book accommodation and/or other services through the Sites, you accept that you will be entering into a contract with the accommodation provider on their standard terms and conditions. If they are provided, SUBICOM will endeavour (but undertake no liability to do so) to make copies of the accommodation provider's terms and conditions available to you.

You understand that SUBICOM may not have conducted any quality or other checks on the accommodation providers and SUBICOM makes no representations about the suitability of the accommodation and/or services offered for sale through the Sites. The inclusion or offering for sale of an accommodation and/or services by SUBICOM does not constitute an express or implied endorsement or recommendation by SUBICOM of such accommodation or services. SUBICOM does not guarantee the accuracy of, and disclaim liability for any inaccuracies relating to, the accommodation and services offered for sale through us.

Nothing in these terms of use shall operate to exclude or limit the liability of SUBICOM for fraudulent misrepresentation or death or personal injury caused by our negligence.

Where you, or any of the people that you are booking on behalf of, are in breach of any of the provisions of these Terms or contravention of any laws or rights of a third party, SUBICOM reserves the right to cancel your booking without refund or compensation in any way and recover from you any costs incurred as a result of your behaviour.

SITES CONTENT, DOCUMENTATION AND BOOKING INFORMATION.
SUBICOM may modify the content of the Sites and/or Terms at any time, and such modification shall be effective immediately upon posting of the modified content and/or Terms on the Sites and your continued use of or access to these websites will be deemed to indicate your acceptance of the modified content and/or Terms.

Any information placed on the Sites relating to hotels advertised on the Sites including, but without limitation, details of the hotel, the availability of rooms at the hotel, the price of the rooms, the facilities available at the hotel, any accreditations afforded to the hotel and/or any details relating to any other services advertised on the Sites have been placed on the Sites by accommodation and/or service providers who are independent businesses and are not agents or employees of SUBICOM or its affiliates. Such information does not constitute any advice or recommendation given by SUBICOM and SUBICOM shall not be held liable for inaccuracies or errors in the accommodation contents or any of its elements. These independent businesses provide the services in accordance with their own terms and conditions which may limit or exclude their liability to you. SUBICOM and its affiliates are not liable for any acts, omissions, breaches or negligence of any such independent businesses or any damages or expenses resulting from the aforesaid. SUBICOM and its affiliates are not liable for any refunds in the event of overbooking or force majeure or any other cause beyond their control.

As SUBICOM acts only as a booking agent SUBICOM will have no responsibility for any errors in any documentation except where those errors were made by SUBICOM.

CONFIRMATION
To confirm a booking, you must be authorised to make the booking by all persons named on the booking and their parent or guardian for all party members who are under 18 when the booking is made. By making the booking, you are confirming that all persons named on the booking accept the Terms and that you will inform the other persons named on the booking of the confirmation details and any other appropriate information. By making the booking you also become responsible for making all payments due under the booking.

SUBICOM will confirm your booking and issue you with an email confirmation. SUBICOM will not deduct any money from your credit card. The accommodation or other service provider with which you enter into a contract will take payment.

In the event that you call SUBICOM by telephone, or are called by SUBICOM regarding your booking, calls may be recorded for monitoring and training purposes. In the event of a dispute regarding a booking, SUBICOM reserves the right to review any call information.


IF YOU CANCEL, AMEND OR CHANGE A BOOKING
You may modify or cancel your booking at any time prior to your arrival date through the Sites.

If you cancel or amend your booking, there may be a cancellation charge or amendment fee levied by the accommodation or other service provider. In any event, if you fail to cancel or amend your booking in accordance with the provider's cancellation or amendment policy, you will be charged a cancellation or amendment fee by the accommodation or other service provider. Further details of cancellation policy are set out in the Sites, your confirmation email and are also shown on the hotel's room details page prior to you making a booking.

If, for whatsoever reason, you do not turn up at the accommodation on the arrival date stated on your booking confirmation email, without prior warning to SUBICOM ("a no show"), this shall be considered a cancellation.

AGE AND RESPONSIBILITY
You warrant that you are 18 years of age or over and have legal capacity to use the Sites and to create a legally binding contract.

You warrant that all personal information submitted during accommodation booking is correct and you accept financial responsibility for all transactions made under your name or account.

You hereby authorise SUBICOM to process all Personal Information about you and the persons named on the booking that has been obtained in connection with your booking. Personal information shall be deemed to include, but not be limited to: any telephone numbers, fax numbers, email addresses, addresses of residences, signatures, ID or passport copies, or any other information belonging to you or your group.

The Personal Information that SUBICOM collects shall be obtained, processed and transmitted in compliance with all applicable laws. For more information please refer to SUBICOM Privacy Policy.

CRIBS (US) / COTS (UK)
Please advise at the time of booking if you require a cot or crib, in order to give this information to the accommodation provider; however, SUBICOM cannot guarantee this request will be met. Such request will be subject to availability and if the accommodation is unable to meet any such request, neither SUBICOM, nor the accommodation, will have any liability to you in this respect. This request may only be available at an additional cost unless otherwise expressly stated in the description of the accommodation provider, and if any additional cost is applicable this should be paid by you direct to the accommodation provider.

BEFORE YOU TRAVEL
SUBICOM is not liable for damages or losses that may result from travel to any particular destination. The Government of your country may help travellers stay safe overseas. Check with your government for the latest advice on conditions and general information concerning specific countries.

It is your responsibility to ensure you have the relevant travel and health documents before departure for the country you are visiting, which shall include, but is not limited to, any inoculations that may be required, identification and passport. SUBICOM shall not be liable for any expense incurred resulting from your missing, incomplete or incorrect documentation or any non-compliance with requirements.

INSURANCE
You are strongly advised to take out adequate travel insurance prior to arriving in your destination. It is your responsibility to check you have adequate insurance cover. The insurance should cover, amongst other things, the cost of cancellation by you, personal losses, all medical costs and the costs of assistance including return to the your country of residence in the event of an accident or illness.

FORCE MAJEURE
SUBICOM will not be liable for any changes, cancellation, effect on your booking, loss or damage suffered by you or for any failure by the accommodation providers and/or SUBICOM to perform or properly perform any of our respective obligations to you which is due to any event(s) or circumstance(s) if the non performance is caused by force majeure. By way of example force majeure includes, but is not limited to, war, revolution, terrorist act, closure of borders, epidemic, natural catastrophe or other causes that seriously affect both parties and other unforeseeable causes beyond SUBICOM's control.

COMPLAINTS OR ISSUES WITH YOUR ACCOMMODATION
In the unlikely event that you have reason to complain or experience any problems with your accommodation please inform the accommodation reception staff or management immediately, to enable them to take appropriate action.

CURRENCY CONVERTER
Currency rates are based on various publicly available sources and are only updated daily; as such they cannot be guaranteed as completely accurate and should be used as guidelines only. Actual rates may vary and you may wish to verify these with a qualified professional.

LEGISLATION AND COURTS OF JURISDICTION
This agreement will be governed by Philippine law and any disputes will be dealt with by the Philippine courts.

SUBICOM takes full responsibility for ensuring that proper security measures are in place to protect your information and store the information in secure databases at secure addresses to prevent unauthorised access. SUBICOM must pass the information on to the relevant suppliers of your travel arrangements. The information may also be provided to security or credit checking companies, public authorities such as customs/immigration if required by them, or as required by law.

To ensure that your booking runs smoothly SUBICOM needs to use information such as your name and address, credit card details, special needs, dietary requirements etc. SUBICOM will apply appropriate security measures to protect this data. However, SUBICOM may disclose information about you to other organisations that are hotel partners or affiliates or to organisations contracted by SUBICOM to manage aspects of the Sites. Additionally, controls on data protection in your destination may not be as strong as in the United States, Hong Kong or Malaysia. SUBICOM will not, however, pass any information onto any person not responsible for part of your travel arrangements. This applies to any sensitive information that you give to SUBICOM such as details of any disabilities, or dietary/religious requirements. If SUBICOM cannot pass this information to the relevant accommodation and/or service providers, SUBICOM cannot provide your booking. In making this booking, you consent to this information being passed onto the relevant persons.

USE OF INFORMATION
You hereby give express consent to allow the incorporation of any data provided to the files of existing personal data in SUBICOM and to the treatment of such for the purpose of management, administration, mediation and contracting of the services offered by SUBICOM, the management of the bookings and the collection of products and services through SUBICOM, call centres; the management of incidences; statistics; commercial publicity and other promotions by means of electronic mail, SMS, MMS or any other similar mean, and the subscription to news bulletins.

You also give express consent to allow SUBICOM to transmit your personal data for marketing purposes to selected Affiliates but only in cases where you have previously activated the option to "opt in" through the websites, authorising this transfer. In such cases, SUBICOM shall only transfer to SUBICOM Affiliates your adequate, relevant and not excessive personal data (name and email addresses) so you will be able to receive marketing material from SUBICOM Affiliates related to the Affiliate's or SUBICOM's products. In any case you have the right to revoke anytime this consent by getting in touch with SUBICOM, and SUBICOM will stop transmitting your information. SUBICOM does not automatically subscribe users to SUBICOM newsletter. In order to receive the newsletter you must opt to subscribe and be informed by email of news and hotel offers. On the Booking form you are able to unselect an option to receive a newsletter from SUBICOM when making your booking. If you would like to unsubscribe from SUBICOM newsletter at any time, you can advise us via the unsubscribe option on each newsletter. SUBICOM may use your personal information to invite you to leave a review following your stay.

If you choose to contact the Hotel directly the options they can offer you will be in line with the terms you agreed to when making the original reservation.
